Section 1: Definition

The terms "we", "us", and "Company" refer to Orisma Technology Co., Ltd. a limited liability company organized and existing under the laws of Thailand, or any successor or assignee of the Company. We are in the business of providing an online platform that our customers may use to create, send and manage emails (which, when sent using the "Services", as defined below, are referred to as "Emails" or "Email Campaigns").

The term "Taximail" refers either to the business or the online platform as the context requires.

The term "Services" refers to the services offered by Taximail.

The term "Member" refers to an individual or entity who or which is registered with us to use the Services.

The term "you" refers to any Member (or another party whose contact information has been provided to us over the internet) who is reading this Privacy Policy, or on behalf of whom this policy is being read.

The term "Website" refers to all websites with the URL https://www.taximail.com.

The term "Personal Information" means information about an individual who is a Member and includes any "Supplemental Personal Information" that we obtain.

The term "Subscriber List" means a list of email addresses of people that one of our Members has sent, or intends to send email, and other information relating to such addresses, that we obtain, and includes any "Supplemental Customer Information". The information in Subscriber Lists is sometimes referred to herein as "User Data".

Section 2: Categories of Information

We collect:

  • The information you provide to us: When you register to use Taximail, communicate with customer service, or send us an email, you provide us with information that we collect. Such information may include your IP address, name, physical address, email address, phone number, mobile number, and other information such as gender, occupation and other demographic information. By providing us with this information, you consent to your information being collected, used, disclosed and stored by us in accordance with this Privacy Policy.
  • List and campaign information: When you upload or create an subscriber list or put together an email campaign with Taximail, we have access to the data on your list and the information in your campaign.
  • Other information we receive and store: When you register to use Taximail, we store "cookies", which are strings of code, on your computer. We also use electronic images known as Web beacons. With those cookies, we are aware of and collect information concerning when you visit our Website, when you use Taximail, your browser type and version, your operating system and platform and other similar information. With Web beacons, we can determine when you the open email we sent you and collect other data. You may turn off all cookies that have been placed on your computer by following the instructions on your browser on how to block cookies that have been placed on your computer. However, if you block our cookies it will be more difficult, and maybe impossible, to use the Services.
  • Tracking our emails to our customers: When we send emails to our own registered Taximail customers, we'll sometimes track who opened the emails and who went so far as to click on any of the hyperlinks. We do this to measure the performance of our email campaigns, and to improve our offerings to specific customer segments.
  • Information from other sources: We may obtain additional information about you by using your email address, or other information, to directly, or through one or more services, search over the internet, or elsewhere. We thereby obtain information that appears to be related to such email address or other information, such as a name, age, and participation in social media websites.

Section 3: Use and Disclosure of your Personal Information

We will use and disclose your Personal Information only as follows:

  • To promote use, including continued use, of our Services. For example, if you leave your personal information when you visit our Website and do not sign up for any of the Services, we may send you one or more emails asking whether you wish to sign up. If you use any of our Services, and may benefit from using one or more other Services we offer, we may send you an email telling you about the other Services.
  • To bill and collect sums owed to us. Uses for this purpose include sending you emails, invoices, receipts and notices of delinquency, to alert you if we need a different credit card number, and to otherwise try to collect money owed. We use third parties to handle secure credit card transaction processing and send billing information to such third parties, who maintain all information in confidence, to process your orders and credit card payments.
  • To send you system alert messages to let you know about temporary or permanent changes to our Services including planned outages, new features offered, version updates, point releases, major releases, abuse warnings, changes to our Privacy Policy and possibly other documents and agreements.
  • To help enforce compliance with our Terms of Use and applicable law including, but not limited to develop and test algorithms, heuristics and other methods and tools for detecting violations and to apply those methods and tools. For example, in this regard, although it's the Member's responsibility to make sure that the email address of anyone who opts out of receiving Emails from that Member is removed from all of that Member's Subscriber Lists, we try to make that happen automatically.
  • To provide customer support and obtain feedback.
  • To protect the rights and safety of us and our employees, Members, owners, officers and others.
  • To meet legal requirements such as complying with court orders and valid subpoenas.
  • To provide information received hereunder to representatives and advisors such as attorneys and accountants to help us comply with legal and other requirements.
  • To prosecute and defend a court, arbitration or similar proceeding.
  • To support and improve the Services we offer including adding features and providing benchmarking and other comparison information regarding, for example, the relative success of a Members' email campaigns compared to other email campaigns by companies in the same or different industries. Benchmarking and similar information are derived from aggregating and analyzing data.
  • To communicate with you concerning your account for an informational, as opposed to promotional, purpose.
  • To transfer your information in the event of the sale of substantially all of the assets of our business to a third-party or in the event of a merger, consolidation or acquisition. However, in such event, any acquirer will be subject to our obligations under this Privacy Policy.
  • To send you informational and promotional materials that you select ("opt-in") to receive.
  • This might also include sharing your information or the information you provide us about your Subscribers with third parties in order to provide and support our Services or to make certain features of the Services available to you. Once we do this action, we take steps to protect your information by requiring the third party to agree into a contract that would require them to use the personal information we transfer to them in accordance to this policy.
  • To transfer your information in the event of a sale, merger, consolidation, liquidation or reorganization the acquirer will be subject to our obligations under this Privacy Policy. This will include their right to access and choice and they will be notified by email or website notice posting.

Section 4: Data Collected from or by our Users

When you use Taximail, you may import into our system personal information you have collected from the subscribers or individuals. You have to make sure that you have appropriate permission to collect data from those individuals for us to collect then and analyze data. If you are a subscriber and no longer wish to contacted by our members, please unsubscribe.

All service providers enter a contract with Taximail that protects personal information and use any personal information consistent with this policy. The information we have with you maybe shared including subscriber, email address with third parties in line with the approved uses.

If you are a subscriber and don’t want to be contacted by one of our members please unsubscribe directly from the Newsletter to update or delete your data.

During the process we retain personal information on the process on behalf or our members as long as needed to provide our Services to comply with our legal obligations, disputes and enforce this agreement.

Section 5: Public Information and Third Party Website

  • Blog. We have public blogs on our Website. Any information you include in a comment on our blog may be read, collected, and used by anyone. If your Personal Information appears on our blogs and you want it removed, contact us here.
  • Social media platforms. We have a social media buttons that you can add on your email campaigns that will enable the recipient to like and share your email campaign. This will help us to know who are the recipient who click the link from your email.

Section 6: Third Party Website

We may disclose personal information of the following types of third parties with the purpose as stated below.

  • Service providers. For example, if it is necessary to provide you something that you have requested like enable a feature such as social profiles, then we may share you and/or your subscribers personal information with the service provider for that purpose. We also work with third parties that requires them to use your personal information only for the provision of that service to us and in the manner that is consistent with this policy like Service Providers including payment processors, hosting services and content delivery.

Section 7: Content of Email Campaign

When you send an email campaign and it bounces from server to server as it crosses the internet. The server administrator can read what you are sending and please refrain from sending confidential information using Taximail. The content of our members email campaign should abide the Terms of Use.

Our support team may review those particular email campaigns but the members who comply with the Terms of Use can reduce the amount of Spam being sent through our servers and help us maintain high deliverability.

Section 8: Your List

Your subscribers list can be done in number of ways on Taximail including importing contacts through a CSV, copy and paste, manually input on the fields and more and it is stored on a secure mail server. We do not in any other circumstance sell or distribute your list. Only authorized employees have access to the subscribers list. You may export (download) your list anytime from Taximail.

If we detect abusive or illegal behavior related to your Subscribers List, we may share your List or portions of it with affected ISPs or anti-spam organizations.

Section 9: Notice of Breach of Security

If a security breach causes an unauthorized intrusion into our system that materially affects you or people on your Lists, then Taximail will notify you as soon as possible and report action taken.

Section 10: We operate in Thailand

Our Headquarter is located in Bangkok, Thailand and our servers are located in Singapore. By using our website you understand and consent to the collection, storage, processing and transfer of your information as described in this policy.

Section 11: Accuracy and Retention of Data

Taximail, will retain the your information for as long as your account is active or as long as you need our Service. If you have data changes or new email addresses then you are responsible for adding them on your list or you can notify us with the change. We may retain your information in order to comply with our legal obligations, resolve dispute, prevent abuse and enforce our agreement.

Section 12: Access

We will give our subscribers (collectively known as our customers) to access to any personal information we hold in our system within 30 days. They have the responsibility to inform their recipients if they want to amend or delete information we hold about them. Unless the subscribers using our Service, upon request will ask us to remove the information of their recipients on our system in accordance of the law.
